1. Agreement Overview

This Software License Agreement ("Agreement") is a legal agreement between you ("Licensee") and Pixel Craft Tool ("Licensor") for the use of Pixel Craft Tool software ("Software").

By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Software.

Subject to the terms and conditions of this Agreement and payment of the applicable license fee, Licensor grants Licensee a non-exclusive, non-transferable, non-sublicensable license to use the Software solely in accordance with the license type purchased.

4. Restrictions

You MAY NOT:

• Copy, modify, or create derivative works of the Software
• Reverse engineer, decompile, or disassemble the Software
• Remove, alter, or obscure any proprietary notices or labels on the Software
• Rent, lease, lend, sell, sublicense, or distribute the Software
• Use the Software for any illegal or unauthorized purpose
• Share your license key with others or use someone else's license key
• Use the Software on more devices than permitted by your license type
• Offer the Software as part of a service bureau or timesharing arrangement

5. Ownership

The Software is licensed, not sold. Licensor retains all right, title, and interest in and to the Software, including all intellectual property rights. This Agreement does not grant you any ownership rights to the Software.

6. Term and Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice from Licensor if you fail to comply with any term of this Agreement.

Upon termination, you must cease all use of the Software and destroy all copies of the Software in your possession.

7. Disclaimer of Warranty

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

8. Limitation of Liability

IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE SOFTWARE.

9. Refund Policy

Due to the digital nature of the Software, all sales are final. However, if you experience technical issues that cannot be resolved by our support team within 14 days of purchase, you may be eligible for a full refund. Refunds are at the sole discretion of Pixel Craft Tool.

10. Software Updates

Licensor may, at its sole discretion, provide updates, upgrades, or modifications to the Software. Licensee agrees to install all updates to ensure proper functionality and security. Some updates may require additional fees depending on your license type.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Pixel Craft Tool is registered, without regard to its conflict of law provisions.
